The RTA Ballot Case: Why Transparency Matters: 

 

Last Monday (Feb. 23, 2009) the RTA  Court hearing ended abruptly after only 12 minutes, leaving a packed courtroom in shock.  The Attorney General’s intervention shut down the hearing when in a surprise court announcement, Deputy Attorney General John Evans said that the Attorney General had obtained a secret court order, that he could share with the judge, but not reveal to the public the contents of the order.
 
People who attended the hearing expressed dismay and started to ask questions about the meaning of a secret court order.  For months we had requested the Attorney General to take control of the ballots and set up a transparent process for counting them. The purpose of the litigation is to ask a court to offer prospective relief by setting up procedures to make all future elections fair and transparent.  That part of the litigation will be decided by the Court of Appeals.
 
As it stands we’re urging Attorney General Goddard to open the investigative process to political party oversight. We maintain that party oversight so fundamental to the public trust demands that verification and transparency must be fundamental to inspection and counting of the RTA  ballots.  Therefore, maintaining the security and integrity of the RTA ballots requires that the ballots be stored under the control of the Attorney General, not within any other election department of any other Arizona County and that the inspection and counting process be open and transparent.

Netroots Nation 2008 Liveblogging...Surprise!

The  conference has been great. Nice hotel, helpful staff and meeting other activists is always the best part. Today I was late for the "Ask The Speaker" session with Speaker Nancy Pelosi. I was debating between Pelosi and sleep, Pelosi and sleep...well, sleep won out for at least 15 more minutes. :)

I ran into Arshad in the hall so I wasn't the only one running late. When I got to the session she was nearly finishing her speech and answering questions people had submitted online. Nothing new or very interesting i.e. I have heard it all before. More canned responses and she pretty much pivoted when the FISA questions were asked which wasn't making the crowd too happy based on grumbles and the holding up of the constitution during her responses. She did handle herself well in general and everyone appreciated her being there knowing she would take some heat, but it didn't solve anything or do anything to absolve the anger and frustration about the lack of progress of this Congress and capitulation on FISA.

Obama's staff members I talked to seem as confused as the rest of us regarding his behavior on that issue, and even his most ardent supporters continually expressed disappointment on that issue. Many others really didn't understand the scope and seriousness until after attending some session this week. It was an eye opener for many who now understand why so many people are up in arms about it. I have kept pretty quite on my level of frustration and disappointed so it was interesting listening to what others had to say, especially those who have been working for him for a few years. I was pretty neutral in the primaries but ended up voting for Edwards so I didn't really have a "dog in the race" so to speak.

Code Pink did a mini protest but it was too far back and not strategic enough to interrupt Pelosi. Instead I think it just upset the people in that area because they couldn't hear. Probably not a good idea upsetting your colleagues who are not your intended target.

I was talking with Xavier, another scholarship winner and very nice guy, when he suddenly says "It's Al Gore!" I dropped everything, grabbed my camera and got as close as I could (not close enough).

I had been reading rumors from Adam B on DailyKos about a "special guest" and my first guess was Al Gore but everyone was telling me "no" so I figured it was someone less interesting. Al Gore and Russ Feingold are two polticians I have always wanted to meet in person and have not had the chance to...so this was quite a thrill.

10 Reasons To Ban Gay Marriage

Being gay is not natural. Real Americans always reject unnatural things like eyeglasses, polyester, and air conditioning.

Gay marriage will encourage people to be gay, in the same way that hanging around tall people will make you tall.

Legalizing gay marriage will open the door to all kinds of crazy behavior. People may even wish to marry their pets because a dog has legal standing and can sign a marriage contract.

Straight marriage has been around a long time and hasn't changed at all; women are still property, blacks still can't marry whites, and divorce is still illegal.

Straight marriage will be less meaningful if gay marriage were allowed; the sanctity of Britany Spears' 55-hour just-for-fun marriage would be destroyed.

Straight marriages are valid because they produce children. Gay couples, infertile couples, and old people shouldn't be allowed to marry because our orphanages aren't full yet, and the world needs more children.

Obviously gay parents will raise gay children, since straight parents only raise straight children.

Gay marriage is not supported by religion. In a theocracy like ours, the values of one religion are imposed on the entire country. That's why we have only one religion in America.

Children can never succeed without a male and a female role model at home. That's why we as a society expressly forbid single parents to raise children.

Gay marriage will change the foundation of society; we could never adapt to new social norms. Just like we haven't adapted to cars, the service-sector economy, or longer life spans.

Citizen Transparency Wins!

The long hard battle for citizen oversight of elections and transparency was won yesterday when the Pima Board of Supervisors decided not to appeal the decision by Judge Miller to require the Board to turn over the database files since 1998 to the Pima Democratic Party as well as any other oversight Party. In addition, Pima Democratic Party attorney Bill Risner will be paid for all but $90,000 of his legal expenses (by us the taxpayers of course). The entire cost to taxpayers is likely around $1 million when you include the County Attorneys, staff, and legal fees they incurred fighting their own citizens on this. This case is a perfect example of poor government and what volunteer citizen activists can do to raise the issues and keep holding their elected officials accountable.

Had the Board of Supervisors not wasted over a year and hundreds of thousands of dollars and just turned over the data, it would have been less painful for all involved. We here at AuditAZ do want to thank the biggest obstructionists on the Board, Sharon Bronson, Ramon Valadez and to a lesser extent Ann Day. Had it not been for their "throw everything at the wall and see what sticks" approach to this case, the general public, local media, and voters and volunteers from the Democratic, Republican, Green and Libertarian parties (plus independents) would not have gotten so outraged and our profile would not have been raised to the level it has. We thank you for all the added members who joined to help us out due to their outrage at the shenanigans both at the Board meetings and in court. Chair Richard Elias didn't exactly show leadership on this issue either.
