Florida Seeks To Enshrine Discrimination in the Constitution

On today's radio show, I talked about the upcoming Amendment 2 that we will vote on in November. I've taken to calling this the Hate Amendment. You should, too. Why? Because this so-called gay marriage ban would not only ban gay marriage, which is already illegal in Florida, it would prevent cities and companies from providing benefits of any sort to gay couples and would also affect many straight couples and just plain roommates in a very negative way. I went through the list of arguments against the Amendment and you can feel free to pick and choose amongst the various arguments based on your location and audience. Here they are:1. It's morally wrong to ban gay marriage. We are talking about taxpaying American citizens and such a ban would deny them a basic human right available to all other citizens.
2. It is unconstitutional under the federal Constitution. You can't deny any citizen a right without due process and without a legitimate reason. Neither of those is present here.
3. It would enshrine hate in the Constitution, something that we really shouldn't be doing. Putting such hatred in our highest document means that such hatred is legitimized.
4. This would be the first time that we used the Florida Constitution to take away rights, something that is at odds with basic constitutional principles. Constitutions exist to protect rights, not remove them.
5. At the federal level, we only tried to take away rights via the Constitution one time -- prohibition -- and it was an unmitigated disaster, leading to the Great Depression and the rise of organized crime in America. Is that the type of history we want to repeat?
6. It's unnecessary. Gay marriage is already illegal in Florida.
7. This law teaches hate to children. By legalizing hate in the Constitution, we tell children that such hate is acceptable. We should never teach hate to children. The government, in particular, should never teach hate to anyone.
8. The Republican slogan is "Less Taxes, Less Government, More Freedom." This Amendment proves that is a lie. This Amendment clearly means less freedom. Less freedom for individuals to choose who they love. Less freedom for cities to give benefits to who they choose to. Less freedom for corporations to provide benefits to their employees as they see fit. A dirty little secret here is that conservatives actually hate freedom. They love it for themselves, but they hate it for the rest of us. This Amendment proves that beyond a shadow of a doubt.
9. Gay marriage has never hurt anyone. Gay adoption has never hurt anyone. No gay right has ever caused any harm to anyone.
10. This Amendment, however, does hurt gay people. Particularly in those cities and working for those companies that do provide benefits. It hurts straight people who fall under its Draconian language. It hurts children who are taught to hate. It hurts us all because we become less civilized.
11. This Amendment would limit various rights that people currently have or might have, such as hospital visitation rights, the right to make decisions for your ill spouse, inheritance rights when there is no will, parental rights and more than a thousand other rights that marriage confers by law.
12. This Amendment would provide cover for Domestic abusers who live in situations where they aren't married. Don't believe me? A judge ruled exactly this in another state where a law with this same language passed.
13. By increasing the legitimacy of discrimination and hatred, this will encourage more hatred, discrimination and violence against gay people.
14. The role of the government is to protect citizens, not hurt them.
15. If you are a Christian, this directly violates the teachings of Christ. In addition to the substitution of earthly judgment for God's judgment it violates the admonition to "judge not, lest ye be judged." Beyond that, Christ never said a single word about gay people, but said thousands of words about helping those in poverty. Christians who obsess about gay people and ignore poverty are not only hypocrites, they are in direct violation of the teachings of Christ. And to those who say that the Old Testament has admonitions against homosexuality, maybe it does, but it also has many other admonitions, almost none of which modern people follow. For instance, one part of Leviticus specifically says that a woman on her period should be kept in a shed outside of the home while she has her period and that she shouldn't be touched. If you don't follow that rule (and many others), choosing to adhere to a strict literal interpretation of the passages on homosexuality are not you living by biblical principles, that's just you being a bigot.
Throughout the year, we'll come back to this issue often as we have a real chance to beat this Amendment and we have a moral obligation to do so.
Note: To run for a State Senate seat in California it will cost the candidate a minimum of $2 million. In one seat a few years ago the Democratic Party candidate spent over $5 million.

Bill just provided another example of the "I did not have sex with that woman -- It depends on what the meaning of 'is,' is," prevarication that he's infamous for.....
"A lot of the way this whole campaign has been covered has amused me," he said. "But there was a lot of fulminating because Hillary, one time late at night when she was exhausted, misstated and immediately apologized for it, what happened to her in Bosnia in 1995."
1. It was in 1996.
2. She told the tale several times in different places.
3. She didn't "immediately" admit it; and certainly never apologized for it.
Bill should have stayed retired from politics rather than drag his name back into the old mud.

Susan ~ I agree about the need for Clean Money Elections and prefer to see the majority of a candidate's fund raising be from a multitude of small donations. It's not necessarily a bad thing to have some monies raised through large donations, in fact it's standard fund raising procedure to look for a small percentage of one's goal to come from large donations. This is a Dem party event and funds raised will presumably be disbursed among many candidates... I've got no problem with that.

Thursday afternoon, CNA/NNOC Board of Directors member Margie Keenan, RN was sitting at home, when she looked up and saw four people staring at her through her front window.
The four -- from the Service Employees International Union -- then started yelling her name and chanting epithets through her window. They left before the police arrived.
Margie later learned that SEIU staff had first showed up on her nursing unit without visitors badges, and pressed co-workers in an effort to try to track her down.
Separately, five SEIU staffers went to the home of another CNA/NNOC Board member, Debbie Cuaresma, RN to harass her, and also shouted at her daughter. The police were called again, but the five ran off before the police arrived.
SEIU’s goal is to silence CNA/NNOC as the voice of nursing in the United States. Don't let them get away with it.
"I am appalled that five bullies would come to my house with cameras and hurl abuse at my daughter. I believe this to be nothing less than a violation of my family's privacy," Cuaresma said.
"Union membership is about collective democracy. Nurses decide they need a union and then choose the union of their choice," Cuaresma said. "We will continue to give voice on behalf of our patients and we will never be intimidated in our struggle to defend our ratios and our hard-won benefits. Stern should rethink his strategy - he will not intimidate me or the CNA."
"I was home alone. Four people were staring at me through the window," Margie reports. "When they saw me they started screaming and trying to scare me. I called the police and they ran off."
"I am a leader of CNA/NNOC. I am proud of my organization, and I will always stand by it in our common goal of fighting for my patients and my colleagues," says Margie. "I will not be intimidated by bullies hired by (SEIU President) Andy Stern."
If SEIU staff show up at your door,
please take the following steps immediately:
1. Don't engage with them
2. Call the police
3. If you are alone, contact your friends and neighbors
4. Call your closest CNA/NNOC office
After that:
1. Try to get a good description of the SEIUers.
2. Write down license numbers of their cars.
3. Take their photo through the window with your cell phones
When the police arrive, file a police report. They can, and should be charged with trespassing, invasion of your privacy, and harassment.
Harassing people at home is a long time SEIU pattern.
Now they have targeted women, and a predominantly female occupation who they think are more vulnerable, with over zealous young men operating under orders from Stern who is trying to force RNs, without their consent, into his union.
We're calling on Stern to immediately renounce the actions of his staff, and cease and desist these despicable attacks against anyone who speaks in opposition to his pro-corporate agenda.
RNs across the U.S. are leaving SEIU for these and many other reasons.

CYD actively encouraged as many young candidates to file and run for a delegate slot as possible. We worked to get a 10% youth goal for the state party delegation.
Many young leaders, including myself and our Vice President, were among the many cut from the delegate lists.
But thanks to the work of many in our organization and hundreds of you, many of us will have our first opportunity to run as a delegate for a President.

I guess the brain came to that conclusion because just before I went to sleep, I was looking into the enterprises that Ron Burkle, Bill's super rich friend was involved in and happened upon Aloah Airlines, which was "rescued" from bankruptcy by the Yucaipa Cos in 2005, at which time the public picked up its pension obligations.
The prospective buyers of Aloha Airlines, the Yucaipa Cos. and Aloha Aviation Investment Group, have stipulated that the airline rid itself of pension plans as a condition of their putting in $100 million capital, setting a deadline for emergence from bankruptcy of this week. Aloha filed for Chapter 11 on Dec. 30, 2004.
Aloah bit the dust on March 20 of this year. A USA story relates the gory detains.
Analysts said Aloha's demise means that go! was able to accomplish its goal of driving the state's No. 2 carrier out of the market.
They cited e-mails uncovered in a lawsuit against Mesa in which Mesa's chief financial officer at the time, Peter Murnane, stated: "We definitely don't want to wait for (Aloha) to die, rather we should be the ones who give them the last push."
Forman, the aviation industry historian, said Aloha did not fail because it was unable to compete in a fair fight. It lost because government regulators "allowed predatory fares to go on for more than a year and a half."
Scott Hamilton, a Washington state-based aviation industry consultant added: "I always said it was a war of attrition and the winner is the one with the most cash and Aloha had the least cash."
Yucaipa Cos is the enterprise from which Bill Clinton is withdrawing and expects to get a hefty pay-out. Their offices in the Cayman Islands treatened to be an occasion for questions.

The Clinton campaign was poorly run from the first event in NH. Obama's did't start much better. Obama's got better; Clinton's didn't.
Some of Clinton's tactics were just grossly insensitive. It's almost as if a bunch of script writers sat around trying to come up with a story line that would sell, like for a situation comedy and some weeks the gags worked better than others. The week of the belly laugh was a real downer for me. It made me cringe. The health care scars turned me off right from the start but she was really wedded to that line. Now that I've discovered they gave a whole hundred days to that effort, I have to conclude that wasn't even a real effort. Of course, the impeachment didn't take all that long either. It probably seemed longer because it was part of a drama series. melodrama. Weren't the Thomasons script writers for TV? And that's what that new friend, Ron Burkle started out in, as well. The entertainment business.
Are we now in re-runs or is this a new season? The entertainment industry has always been a place where large sums are collected and lost with little to show for it. Perhaps what we should really have a closer look at is the extent to which Ronald Reagan brought the entertainment industry to the White House. It wasn't just the public relations crew.

This country is gone, folks, unless impeachment is begun before putz leaves. If not, we'll have another unitary executive and I don't care who it is...it won't be pretty and I don't hear any of them saying that their first order of business will be to restore our rights. It's just not part of their debate or speeches or mindset it seems. A little lip service now and then. If BO is so cool, how come he's not shouting for impeachment? Same for HC.
HC will "hit the ground running."
BO will sit in the Offal Office and think, "This is cool." this is utter bullshit - do you really think we'd want to vote for him if we thought this were true?.
NONE OF THEM FOR PRESIDENT.

People crow about BO campaign raising the most money in history. So the nomination is bought, as usual, by the people.....BUT the people are given no good choices.
If you go into a store thirsty and want milk but there's only water on the shelf, you buy water.
Same for all campaigns. It's obscene.
Our country up for sale but it's really not the people buying...it's the CM limiting our choices and pushing us in one direction. While the race is taking up most of the airspace, putzco is going about controlling the future and hamstringing any good a dem prez might want to do...besides working to get immunity for himself.
Are the voters smart enuf to choose well? No. Evidence: HC and BO were far from the best choices. And most of us, even BO supporters, will agree, at least deep down.
I think people are angry becuz they know we could have done much better.
The early caucus and state thingies have to go. We should all get to vote, all of us, on the same day or weekend. Public financing only. Take out the money and early states and we may have a prayer of nominating a progressive.

When Hillary Clinton talks about having worked 35 years on a project, she sounds just like one of those script writers with a wall of rejection slips who plans to have a winner this time. You can have a lot of disappointment in thrity-five years. The spouse has been writing scripts for over 40. A few times he sparked some interest from a producer, but the first step was always putting together a package, lining up investors for an unrealistic budget. I actually kept a ledger on one such project to keep track of where our money went. We have a poster for our memory wall. There was never any income. 40 years of putting unpaid spare time into something with no pay-off--that's about par for the course. Thousands of scripts get written for everyone that gets made into a movie or a series and still we end up with dross.
When you look at some of the great things that are being put together to support Obama and compare that with Hillary's ads, you have to conclude that the PR/entertainment industry is disfunctional.Lots of people are making a profit, but the product is garbage.
It's the profit motive, stupid.
Funny that Bill should bring up the spy, Mata Hari, in regards to Hillary in Bosnia because, of course, that's what they were hiding, an opportunity for the press to dig up and refer to Camp Bondsteel, a spy installation Bill Clinton had built by KBR on the pipeline carrying oil to Bar. Bondsteel is the prototype for the mega bases built in Iraq. How do we know it's for spying? Because the personnel working there do not interact with the local population. They're quite secure on their mountain tops (two leveled to fill the valey in between) and most traffic in and out is by air.
BTW, the Boston Globe has an AP follow up on the principals' story ABC showed on Wednesday.
I saw the clip of Hillary cackling - that's downright scary and it was one of the few times I've seen her completely at a loss for words. which was an honest answer in itself - there was nothing she could say to defend Bll's Colombian $$$$$ and the fact that this money also benefitted her and thus her campaign when she laoned herself the $5mil.
and from reading other blogs and the absolutely nasty thigs going back and forth between 'Clinton and Obama supporters' makes me wonder if the repubs aren't having a bit of fun blending into the blogs and tossing bombs to enflame the dems. I know there are some who won't vote dem if their guy/girl don't get the nom, but the sheer volume of nasty comments leads me to believe that Rove or somesuch has a new crew of active trolls working overtime this time around.

Hillary needs to head back to the Senate and resume her career as a public servant, before the fund raising leads to an indictment. Taking money from special interests seems to be a badge of honor there, and I'm sure she will still have friends among her co-workers.

BTW, I disagree with most of the reasons (15) being offered for why Domestic partnerships should not be restricted to same-gendered individuals. Gender is an irrational and irrelevant criterion for a legal relationship. What the consequences for the participants or non-participants might or might not be subsequent to such a legal relationship being established or not is also irrelevant. We ought not to make laws dealing with unknown and unrealistic potentialities.
But, reasons 4 and 14 are false. The purpose of the Constitution is to define what duties and obligations the agents of government have. The Bill of Rights was an add-on which we might well regret since it illuminates some rights while leaving others out and gives some people the impression that the purpose of the Constitution is other than it is. Also, the purpose of government is not to protect; it's to repulse and correct negative realities.

IMO McCain is starting to sound like a real pro --

Yes Linda thats true......not one but 3 courses on ME contemporry and past history back in 1976 and 1977/78..........at the ripe old age of 22 I came to the conclusion that the US should NEVER involve itself in that region politically or diplomatically..that eventually, it would come back to haunt us......I see nothing in 2008 to counter that bold prediction...........
The evidence speaks for itslef........our politicans, leaders and indirectly the military are now merely tools of not one but probably several ME nations plus the fact that this country gave up in the 70s the fanyasyic idea of oil independency for corporate greed, personal wealth and a lazy populace that refused to give up their Chevy trucks............now, their kids are paying the ultimate price and our country has a very large bullseye on its back.................
Perhaps, if more Americans would learn the truth about their own country, the history of that region and our involvment, they make decide to make the right decision........obviously, we have made all the wrong decisions since that time..............

I guess I'm "lefter" than most current BFA bloggers--perhaps it's the Canadian influence.
I see myself as typical of the "Democratic Wing", which Tom rather narrowly defines as those who cling doggedly to every position Howard Dean has ever held.
Like the vast majority of BFAers, I admire Howard greatly, but disagree with some of his positions.
I will say this for Howard. His 04 campaign (unlike the current Dems') dealt with all issues in a forthright an unambiguous manner--probably what turned the Democratic estabk\lishment and the media agaionst him

If he was referring to Mike's perspective on the ME, we should all take him very seriously.
From 1950 onwards, the US has been wrong wrong wrong in the ME, and it's costing us bigtime.

The Rethugs convinced evangelical voters that gay marriage was a religious issue. They used it as a "wedge issue" effectively in the 04 Pres election. This is typical of the divide, blame somebody and hate them strategy of Turdblossom. I always thought of it as much more of an equal rights issue. JM in NY
